In the light mainly of the Mox and Kadi decisions, the reflections that follow relate to the conditions in which the European Court seems to want both to cohabit and to collaborate with the international legal and political "authorities". Its case law seems to attest to some nervousness and a certain withdrawal into its shell, the justifications for which do not appear clearly. This is probably regrettable, even though it may sometimes serve the interests of both the European Community (Union) and international relations.

A la lumière principalement des arrêts Mox et Kadi, les réflexions qui suivent portent sur les conditions dans lesquelles le juge communautaire paraît vouloir tout à la fois cohabiter et collaborer avec les «autorités» juridictionnelles et politiques internationales. Sa jurisprudence semble témoigner de quelque frilosité et d’un certain repli sur soi, dont les justifications n’apparaissent pas clairement. Ce qui est sans doute regrettable, même si cela peut parfois servir l’intérêt et de la Communauté (Union) européenne et des relations internationales.
