The phenomenon of the servi fugitivi in ecclesia blends different aspects : the rising and the consolidation of the right of asylum in churches ; the slaves' flight ; the practice of the servi fugitivi to take shelter in a church or in a monastery, alleging divine call to be admitted to ordination or to a monastic order, so as to obtain freedom. The position of the official Church and of the ascetical spheres is reconstructed, and the secular legislation (IV-Vth centuries) on the right of asylum and the slaves' ordination is analyzed ; then are described the outlines of the rules laid down by Justinian. From the so called Bullae Sanctae Sophiae, two extravagantes constitutiones the paternity of which has been attributed to Justinian, it is clear that the problem is still relevant in the course of the VIth century.

• Nel fenomeno dei servi fugitivi in ecclesia si fondano diversi profili : le problematiche inerenti al sorgere e al consolidarsi del diritto ďasilo nelle chiese ; la fuga degli schiavi ; la prassi dei servi fugitivi di rifugiarsi in chiesa o in monastero, accompando vocazioni piu o měno sincere per farsi ammettere alla ordinazione o monacazione e ottenere cosi la liberta. Dopo aver ricostruito le posizioni della Chiesa ufficiale e degli ambienti ascetici, viene analizzata la legislazione secolare del IV-V secolo tanto in materia ďasilo quanto con riferimento all'ordinazione degli schiavi, per poi trattegiare i contorni della disciplina dettata da Giustiniano. Dalle cd. Bullae Sanctae Sophiae, due extravagantes constitutions délie quali è stata rivendicata la paternité giustinianea, emerge chiara- mente la rilevanza della problematica ancora nel corso del VI secolo.

• Dans le phénomène des servi fugitivi in ecclesia on peut distinguer différents aspects : les problématiques concernant la naissance et la consolidation du droit d'asile dans les églises ; la fuite des esclaves ; la pratique des servi fugitivi de se réfugier dans l'église ou le monastère campant ainsi des vocations plus ou moins sincères pour se faire admettre à l'ordination ou à la prise d'habit et obtenir de cette façon la liberté. Après avoir redéfini les positions de l'Église officielle et des milieux ascétiques, l'auteur analyse la législation séculaire des IVe- Ve s. sur le problème de l'asile mais aussi de l'ordination des esclaves, afin d'ébaucher les contours de la discipline dictée par Justinien. Des soi-disantes Bullae Sanctae Sophiae, deux extravagantes constitutiones dont on a accordé la paternité à Justinien, apparaît clairement l'importance de cette problématique tout au long du VIe s.
