Our time is shaken by many political questions, that is to say, relating to how to organize the governance of individuals in a given territory and time, as well as many social questions, which affect relationships between individuals within society more broadly. Through our conversations and our behaviors, each of us seems to wonder about how the community should organize itself, should constitute itself. Our conduct is an expression of our relationship to the society in which we live, and by doing one thing over another, we are showing what we value most. In doing so, the figure of the Legislator tries to circumvent this anthropological problem with a fictional contribution to allow the political treaty to remain in the field of politics. Deciphering the influence of the Legislator on the work thus amounts to reintroducing anthropology into politics, and to show that the principles of political law are in fact dependent on conditions relating to human nature.

L’époque qu’est la nôtre est secouée par de nombreux questionnements politiques, c’est-à-dire qui se rapportent à la manière d’organiser la gouvernance des individus dans un territoire et un temps donnés, ainsi que par de nombreux questionnements sociaux, qui touchent aux rapports entre les individus au sein de la société de manière plus large. Au travers de nos conversations et de nos comportements, chacun de nous semble s’interroger sur la manière dont la communauté devrait s’organiser, se constituer. Nos conduites sont l’expression de notre rapport à la société dans laquelle nous évoluons, et en faisant telle chose plutôt que telle autre, nous donnons à voir ce à quoi nous assignons le plus de valeur. Ce faisant, la figure du Législateur tente de contourner ce problème anthropologique par un apport fictionnel pour permettre au traité politique de rester dans le champ du politique. Décrypter l’influence du Législateur sur l’ouvrage revient donc à réintroduire l’anthropologique dans le politique, et à montrer que les principes du droit politiques sont en fait tributaires de conditions relatives à la nature humaines.
