Several doctrines have been proposed concerning the basis for diplomatic protection. In each of them inconsistencies with the legal regime of diplomatic protection can be found. Accordingly this article proposes another way of contemplating the basis for diplomatic protection, the starting point of which is a distinction between the event constituting the violation of a right, termed “ injury”, and the event constituting a pecuniary or non-pecuniary loss, termed “ damage”. The great originality of diplomatic protection is that it rests on a dissociation between the entity incurring the prejudice, which is a state, and the person suffering the damage, who is a national of that state.

Plusieurs doctrines ont été proposées s’agissant du fondement de la protection diplomatique. Or, pour chacune d’elles, il est possible de relever une incohérence avec le régime juridique de la même protection diplomatique. C’est pourquoi cet article propose une autre façon d’envisager le fondement de la protection diplomatique dont le point de départ est une distinction entre le fait constitutif de la violation d’un droit, appelé préjudice, et le fait constitutif d’une perte, patrimoniale ou extrapatrimoniale, appelé dommage. La grande originalité de la protection diplomatique est qu’elle repose sur une dissociation entre la personne préjudiciée, qui est un État, et la personne «dommagée » , qui est un national de ce dernier.
