This paper looks first at the growing place of the law in trade union actions. It shows the ambivalent character of the law which provides at the same time a framework and a tool for the actions of trade unions. Labour law is in this respect an object of conflicts which also take place in courts. In this context, the paper examines then which are the challenges of the legal education given to trade union members within the Institutes of labour studies. These challenges are related on the one hand to democracy and, on the other, to a certain idea of University.

Cet article étudie tout d’abord la place croissante du droit dans l’action syndicale. Il montre le caractère ambivalent du droit qui forme à la fois un cadre et un outil de l’action syndicale. Le droit constitue à cet égard un objet de luttes qui se déroulent aussi sur le terrain judiciaire. Dans ce contexte, l’article s’intéresse ensuite aux enjeux de la formation juridique dans les Instituts du travail. Ces enjeux tiennent d’une part à des exigences démocratiques et, d’autre part, à une conception de l’Université.
