As concerned with renal transplantations, we know long ago how to obtain a free, clear and formal consent : we have to ask not only to the parents but also to the children, as soon as they are able to understand and express. Three sets of dispositions assert the children 's right to express themselves concerning any intervention on the individual, either therapeuthic or not. These three sets are the debates in the ethic instances, both national and international, the law Huriet (1988), and the Convention of Children's rights (1990). It remains to ask what is maturity for an ill child, what means right to take the floor, and what happens when the child's choice doesn't meet the parents' choice.

Depuis longtemps nous savons, Michel Broyer et moi-même concernés par les transplantations de rein, que pour obtenir un consentement libre, éclairé et exprès il fallait s'adresser non seulement aux parents mais aussi aux enfants dès que leur parole et la compréhension de notre propos le permettaient. Mais si trois ensembles de dispositions — délibérations des instances éthiques nationales et internationales, loi Huriet (décembre 1988) et Convention des Droits de l'Enfant (1990) — font état du droit de l'enfant à s'exprimer vis-à-vis de tout acte avec ou sans visée thérapeutique pratiqué sur sa personne, il reste à se demander ce que c'est que la « maturité » pour un enfant malade et « le droit à la parole » et l'éventuelle contradiction entre le choix de l'enfant et celui des parents.
