Plus que jamais la « jurisfiction » a toute sa place à l’égard du transhumanisme et davantage encore lorsqu’il est question de droits fondamentaux. Reste à savoir si l’individu et ses droits fondamentaux sont susceptibles de constituer un appui pour un transhumanisme favorable à la personne (I). Les hypothèses sont nombreuses, et le droit a la possibilité d’inventer ou de transformer, presque à l’infini, tous les concepts. Quoi qu’il en soit, les droits fondamentaux devraient-ils être compris comme une limite sous-jacente, si la réalité, à l’instar de l’imagination, devenait « folle du logis » (II) ?

More than ever, “jurisfiction” has its place with regard to transhumanism and even more so when it comes to fundamental rights. It remains to be seen whether the individual and his fundamental rights are likely to constitute a support for a transhumanism favorable to the person (I). The hypotheses are numerous, and the law has the possibility of inventing or transforming, almost infinitely, all the concepts. In any case, should fundamental rights be understood as an underlying limit, if reality, like the imagination, were to become mad ? (II).
