Questo testo tratta il tema dell’esempio nella prospettiva del discorso giuridico. Attraverso una ricostruzione della semantica influente legata al tema dell’esemplarità, il rapporto fra diritto ed esempio viene descritto a partire dall’intersoggettività su cui si basa la validità esemplare, ma anche a partire dal tema filosofico del giudizio riflettente e dalla retorica dell’exemplum. Il lavoro, proprio grazie all’allargamento del campo prospettico da cui osservare l’esempio, dimostra che la normatività giuridica funziona attraverso meccanismi complessi in cui induzione, deduzione e abduzione operano congiuntamente e contestualmente.

This text deals with exemplarity from the perspective of legal discourse. Through a digression in the semantics of exemplarity, the relationship between law and examples is described in its connection with intersubjective validity, the philosophical problem of reflective judgement and the rhetorical tradition of the exemplum. This contribution shows that legal normativity works through complex mechanisms in which induction, deduction and abduction interact permanently.
