L’intérêt général est formellement présenté comme un objectif conditionnant la constitutionnalité des atteintes législatives portées à certains droits et libertés garantis par la Constitution. Pourtant, il est appréhendé dans le contrôle a posteriori comme un instrument de légitimation de ces atteintes, le juge constitutionnel s’interdisant d’apprécier la réalité des objectifs poursuivis par le législateur. Il est en outre banalisé au point que, sous l’impulsion du contentieux constitutionnel économique, il finit par contribuer à une surdétermination des intérêts économiques dans la protection des droits et libertés. Il n’est pas interdit toutefois de penser que la protection de l’environnement offre enfin au juge constitutionnel l’opportunité d’un rééquilibrage.

General interest is formally presented as an objective conditioning the constitutionality of legislative infringements of certain rights and freedoms guaranteed by the Constitution. However, it is understood, in the judicial review, as an instrument for legitimizing these infringements. The constitutional judge refrains from assessing the reality of the objectives pursued by the legislator. Moreover, it has become so trivialized that, under the impetus of constitutional litigation on economic matters, it ends up contributing to an over-determination of economic interests in the protection of rights and freedoms. It is however possible to think that the protection of the environment finally offers the constitutional judge the opportunity of a rebalancing.
