The aim of this article is to highlight the differences between, on the one hand, the text of Protocol n° 16 – which has many theoretical specificities – and, on the other hand, the realities of the judicial dialogue that has manifested itself through the two referrals to the French Court of Cassation and the Armenian Constitutional Court. Despite the laudable intentions of the authors of Protocol n° 16, it is not certain that the latter will succeed in generating a wide-ranging dialogue dynamic, given its optional nature and the absence of binding force of opinions.
