Devant l’ampleur et la monstruosité des crimes nazis, collectifs ou individuels, les historiens ont longtemps buté sur leur causalité profonde, faisant basculer leurs auteurs du côté de l’inhumain, du barbare. Ces comportements s’appuient pourtant sur des fondements normatifs et un argumentaire juridique. Philosophes, juristes, historiens, médecins ont en effet élaboré des théories qui faisaient de la race le fondement du droit, et de la loi du sang la loi de la nature qui justifiait tout, notamment la violence totale et l’extermination. Voilà comment tuer un enfant au bord d’une fosse pouvait relever de la bravoure militaire face à l’ennemi biologique.

Faced with the scale and monstrosity of Nazi crimes—be they on a collective or individual level—the underlying causality has long been a stumbling block for historians, shifting the perpetrators over to the side of the inhuman and the barbaric. And yet this behaviour is based on normative foundations and a legal argument. Indeed, philosophers, legal experts, historians and doctors have developed theories making race the basis of law, and the law of blood the law of nature that justified everything, notably total violence and extermination. That is how, faced with the biological enemy, killing a child at a pit’s edge could fall within the ambit of military bravery.
