Bien que la résistance à l’oppression soit un droit reconnu par la Déclaration des droits de l’homme et du citoyen de 1789 – qui figure en préambule à la Constitution française –, la justice a le plus grand mal à admettre la valeur juridique de la justification d’un acte délictueux au titre de la désobéissance civile. Est-il envisageable qu’un tribunal juge un acte de désobéissance civile en tant que tel ? Cet article aborde cette question sous deux angles. Le premier sera d’envisager le passage du droit moral de résister à l’oppression à la reconnaissance d’un droit à la désobéissance civile, à partir de la multiplication des « droits suspensifs ». Le second angle sera de savoir si cette forme d’action politique qu’est la désobéissance civile est compatible avec sa normalisation juridique.

Although resistance to oppression is a right recognized by the Declaration of the Rights of Man and of the Citizen of 1789 – which appears in the preamble to the French Constitution – justice takes great pains to accept the legal value of the justification of a criminal offense in the name of civil disobedience. Is it possible, though, to imagine a court trying an act of civil disobedience as such? This article addresses this issue from two angles. First, it considers the passage from the moral right to resist the recognition of a legal right to civil disobedience from the vantage point of the proliferation of “suspensive rights.” The second angle is whether or not the nature of civil disobedience as a form of political action allows for its legalization.
