Bien qu’elle puisse être surprenante au premier abord, et même si elle reste ignorée pour l’essentiel par les spécialistes du contentieux administratif, la question de la renonciation à certains moyens au cours de l’instruction n’en est pas moins légitime. Celle-ci rend compte, en effet, d’une stratégie qu’il s’agisse de celles des parties poursuivant un intérêt médiat ou immédiat, ou qu’il s’agisse du juge cherchant à réduire les délais d’instance ou le stock des affaires à traiter. Ces stratégies se déploient à la faveur de procédés différents suivant que les renonciations répondent à la volonté des parties ou que ces renonciations soient subies par elles. Observer les renonciations souhaitées par les parties conduit à identifier des choix tactiques dont l’objectif ne se limite pas à la victoire contentieuse mais s’étend à l’intérêt global celle qui renonce à certains moyens. Observer les renonciations subies conduit à dépasser les apparences, notamment celle du volontarisme, pour déceler l’existence de règles autoritaires du contentieux dont on peut, à certains égards, déplorer l’instrumentalisation.

Although it may seem surprising at first sight, and even though it is still largely passed over by administrative litigation specialists, the question of waiving certain pleas during preliminary investigations and hearings is no less legitimate for seeming so. It is evidence of a strategy, whether on the part of parties pursuing a direct or indirect interest or of a judge seeking to reduce the time taken to deal with individual lawsuits or his caseload as a whole. Such strategies are deployed as the result of various forms of behaviour depending on whether the waivers meet the parties’ wishes or are submitted by them. Observing the waivers that meet their wishes leads to identification of tactical choices whose objectives are not limited to winning the lawsuit but aim to match the interest of the party waiving the pleas with the general interest. Observing waivers submitted by them takes us beyond outward appearances, of proactiveness in particular, and reveals the existence of authoritarian rules of litigation whose exploitation is in some respects to be deplored.
