L’apatridie qui prive une personne de son « droit à une nationalité » est tout à la fois une conséquence technique, découlant des entrelacs du droit international privé, et un phénomène politique, traduisant des politiques discriminatoires, qui touchent principalement aujourd’hui les femmes et les enfants. Malgré les efforts de la Société des Nations puis des Nations unies, les normes juridiques visant la prévention et la réduction des cas d’apatridie sont insuffisantes et les impératifs humanitaires de protection restent une priorité dans un monde en pleine crise migratoire.

Statelessness, which deprives people of their “right to a nationality”, is both a technical consequence of the complexities of international private law, and a political phenomenon stemming from discriminatory policies which affect mainly women and children today. In spite of the efforts of the League of Nations and then the United Nations, the legal norms aiming to reduce and prevent cases of statelessness are insufficient, and humanitarian protection needs to remain a priority in a world experiencing a major migratory crisis.
