The recent parliamentary debate in Belgium, which led to the law under which euthanasia is no longer punishable, was remarkable in that both the protagonists and the opponents of the bill in turn appealed to modern humanism and the ideal of the autonomy of the person. Contrary to those who consider that any reticence in regard to this law can only be justified by religious and pre-modern motives, we wish to show in this article how our conception of autonomy, which is of Kantian inspiration, invites us to prefer justification of the practice of euthanasia — by means of the concept of a state of necessity — rather than depenalization. Le récent débat parlementaire qui a conduit, en Belgique, à l'adoption d'une loi dépénalisant l'euthanasie, a présenté la particularité de voir, tour à tour, partisans et opposants de la proposition se prévaloir de l'humanisme moderne et de l'idéal de l'autonomie de la personne. Contre ceux qui estiment que toute réticence par rapport à cette loi ne peut se justifier que par des motifs religieux et prémodernes, nous voudrions dans cet article montrer comment notre conception, d'inspiration kantienne, de l'autonomie nous invite à préférer une justification de la pratique d'euthanasies par la notion d'état de nécessité plutôt que sa dépénalisation.
