At its creation in 1890, the French union of municipalities illustrates the will of the State to build an intermunicipal cooperation around a theoretical model. This model gave a large role to a kind of institutional subsidiarity which was based on the primacy of the municipal will. Gradually weakened by a new functional conception of intermunicipality initiated by the State, the institution of unions of municipalities experienced, in legislative terms, a significant qualitative and quantitative erosion. This erosion, driven by the affirmation of new institutional models with radically different frames, shows the decline of the intermunicipal model based on subsidiarity.

À sa création en 1890, le syndicat de communes illustre la volonté de l’État de construire la coopération intercommunale française selon un modèle théorique faisant une large place à des logiques de subsidiarité institutionnelle, articulées autour de la primauté de la volonté communale. Peu à peu détricotée par un nouveau regard fonctionnel de l’État sur l’intercommunalité, l’institution du syndicat de communes a connu, sur le plan législatif, une importante érosion qualitative et quantitative. Cette érosion, due à l’affirmation de nouveaux modèles institutionnels aux contours radicalement différents, témoigne également du recul du modèle de la subsidiarité intercommunale.
