Patient consent has become a fundamental right at the heart of medical activity. Patient consent must be seeked in every examination, and especially in the most intimate of them all, the gynecological examination. However, the lack of consent to a medical procedure hardly seems to be a criminal offence, since the doctor’s immunity is based on the therapeutic nature of the procedure. A patient’s failure to consent to a gynaecological examination carried out in accordance with the latest scientific findings does not therefore constitute rape. A change would certainly be welcome to better protect this fundamental right.
