La présente contribution a pour objet de montrer en quoi la confrontation des théories de la justice et de la démocratie à la question du handicap oblige celles-ci à reconsidérer leur fondement contractualiste et à construire un cadrage qui tienne compte de la situation des personnes les plus vulnérables. Dans cette perspective, l’approche par les capacités est certes une avancée dans la prise en compte de la situation de ces personnes et de leur capacité spécifique. Cependant, cette ouverture à la situation des personnes handicapées nous semble exiger une radicalisation de cette prise en compte, et nous engage à construire un cadre éthique et politique qui puisse rendre compte des conditions d’une participation plus effective des personnes en situation de handicap à la définition de leur projet individuel et collectif.

Chapter 4. Care, capabilities and disability: what ethics for an inclusive society? The purpose of this contribution is to show the way in which confronting theories of justice and democracy with the question of disability constrains the former to reconsider their contractarian groundings and to build up a frame that takes into account the effective situation of the most vulnerable persons. In this perspective, the approach through capabilities, while it does appear as an advance in the taking into considerations the situation of these persons and their specific capacity, requires nevertheless a futher radicalization of this consideration and analysis, as well as, the construction of an ethical and political framework that could take account of the required conditions for an effective participation of the disabled persons in the definition of their individual and collective project.
