Les récentes déclarations du président de la République concernant le dépôt dans les mois qui viennent d’un projet de réforme de l’ordonnance de 1945 destiné à revenir aux ambitions humanistes du texte d’origine ne peuvent être prises au sérieux que si elles s’accompagnent d’une désintoxication des esprits profondément imprégnés par l’idéologie sécuritaire et l’invasion des concepts néolibéraux touchant à l’efficacité. Il importe de renoncer à une politique pénale empêchant les magistrats d’individualiser leurs décisions et de rejoindre les préoccupations de la recherche actuelle qui s’intéresse aux sorties de la délinquance et à la pertinence des divers instruments éducatifs en amont et en aval de l’intervention judiciaire.Une procédure respectant les différentes perceptions de la temporalité, l’abandon de la progressivité systématique des sanctions, et la reprise d’une diversification des équipements sont indispensables pour y parvenir.

The crossing of pathsThe recent declarations of the President of the Republic concerning the tabling in the coming months of a bill to reform the legislation of 1945 with the aim of returning to the humanist ambitions of the original text can only be taken seriously if they go hand in hand with a detoxification of minds profoundly impregnated by the ideology of security and the invasion of neo-liberal concepts concerning efficiency. It is important to abandon a penal policy preventing magistrates from individualising their decisions and to return to the preoccupations of current research which is interested in strategies for overcoming or getting out of delinquency and in the relevance of diverse educative instruments before and after the judicial intervention. There are three requirements for achieving this : a procedure that respects the different perceptions of temporality ; the abandonment of the systematic progressive nature of sanctions ; and the resumption of a diversification of forms of equipment.
