This present article has the objective to analyze the child's active subjectivity under the UN Committee on the Rights of the Child. In this, it will be discussed the position of the child's subalternity as a subject in the society, based on Gayatri Spivaks theoretical view and some other authors that brings out a debate of the subjects constitution, seeking to further the principle of "voice and participation". Therefore, mechanisms and activities from team works and Committee sessions will be presented related to new possibilities in the advent of the "Optional Protocol of 2014". In this respect, discussions will be addressed related to international law and the children's rights in the international and universal system of protection of human rights.
