Tout comme le notaire, le tabellion est chargé de l’authentification des contrats qui prend deux formes : la minute, dans le registre du tabellion qu’il a le devoir de conserver ; des lettres (ou grosses) que les parties peuvent demander. Grâce au fonds du tabellionage ancien d’Alençon, nous savons qu’il existe une forme préliminaire à ces deux étapes, le brouillon. L’étude d’un de ces brouillons (le bail d’une métairie) met en lumière l’interaction entre les négociations des parties et l’empreinte notariale qui, seule, rend le contrat valide.

Just as the notary public, the tabellion was in charge of authentifying contracts. This he achieved in two ways, by recording a « minute » in the registry which he was bound to keep, and by delivering « letters » (or grosses) when requested to do so by the parties in the contract. Thanks to the preservation of the Alençon tabellionage archival fund, we know that there was yet another stage preliminary to these two instruments, namely the first draft (brouillon). The study of one of these drafts, a share-cropping lease, throws light on the interaction between the parties negotiating the contract and the notarial instituion which alone had the power to officialize it.
