L’étude aborde un domaine de la recherche totalement ignoré mais parti¬culièrement important dans le contexte de la vie juridique. Elle traite, d’une part, des langues de la justice en Afrique noire francophone et de la communication judiciaire déviante qui résulte de l’usage d’une langue officielle et étrangère, et, d’autre part, du recours que peuvent constituer les dispositions en matière de langue et de liberté d’expression des Constitutions africaines. Elle montre que ces textes constituent sinon un cadre réglementaire de l’utilisation des langues africaines au sein de l’instruction ou du procès, du moins les fondements de l’élaboration d’une réglementation. Elle conclue en soulignant le paradoxe de l’utilisation de la langue de la minorité de la population pour juger la majorité de celle-ci.

African Constitutions and the Language of JusticeThis study touches on an area of research totally ignored but particularly important in the context of judicial life. It deals on the one hand with the languages of justice in French-speaking Africa and the abnormal judicial communication which results from the use of an official and foreign language, and on the other hand with the help brought by the African Constitutions in matters of language and freedom of speech. It shows that these texts could be considered either as a frame of rules for the use of African languages during investigations and trials, or as the foundation for the elaboration of a set of regulations. It concludes by underlining the paradox presented by the use of a minority language to judge the majority of the population.
