Toward the unification of legal culture in the Balkanic countries : the acculturation of business lawFollowing the profound transformations triggered by the collapse of the communist regimes, the harmonization of legal systems and judicial institutions has introduced significant changes in the legal systems of various Balkanic countries. Legal transplants from Western European countries and the U.S.A. achieved mixed success since they rarely took into account the local legal and political culture. This failed process of legal acculturation is illustrated by two examples of legislations in Bulgaria and Moldavia where the author worked as a legal expert in the drafting of new security regulations and insolvency laws. In both countries, the business legal culture was not yet adapted to the necessary changes and still reflected a form of “legal nihilism” inherited from their communist past that limited or even subverted the scope and effect of the legal reforms. The success of legal reforms in Balkanic countries requires thus a much better understanding of their legal tradition and their social, economic, and political culture.
