La religion est plus souvent traitée dans la théorie constitutionnelle sous l’angle de la séparation que de la légitimité religieuse du pouvoir, une problématique éminemment culturelle. Cet article se propose d’étudier la place du religieux dans la théorie constitutionnelle japonaise en partant d’une analyse des spécificités du fait religieux japonais. Il observe comment ces spécificités ont créé une théorie constitutionnelle originale, qui cherche à circonscrire une religiosité japonaise insaisissable, mais qui peut être définie comme « communautaire » et « civique ». Il montre comment cette religiosité a été matérialisée dans la religion impériale d’avant-guerre, puis comment l’après-guerre en a connu une sécularisation qui pose la question de la place de la culture religieuse dans un état laïc.

Religion is more often treated in constitutional theory from the point of view of separation than of the religious legitimacy of power, an eminently cultural issue. This article proposes to study the place of religion in Japanese constitutional theory, starting from an analysis of the specificities of Japanese religion. It observes how these specificities have created an original constitutional theory, which seeks to circumscribe an elusive Japanese religiosity, but which can be defined as “community” and “civic”. The author shows how this religiosity was materialized in the pre-war imperial religion, then how the post-war period saw a secularization of it that raises the question of the place of religious culture in a secular state.
