L’article analyse les prémisses, les modalités d’action et le fonctionnement actuel des comités d’éthique en recherche (CÉR) comme étant basés sur une éthique procédurale dont l’adoption et l’application en tant que modèle sont hautement problématiques. D’une part, le chercheur est constitué en déviant potentiel, en être moralement suspect. D’autre part, la science étant désormais redéfinie en activité potentiellement dangereuse, les CÉR s’affairent à la contrôler et s’ingèrent ainsi dans la procédure scientifique. L’article conclut en proposant de penser l’éthique non pas comme un principe mesurable, vérifiable et maîtrisable, mais plutôt comme un point d’équilibre à atteindre entre les diverses parties concernées.

The article analyses the premises underlying the creation of research ethics boards/committees (REBs) and the manner in which they operate. It problematizes the adoption of a procedural approach to ethics by unveiling how the researcher is constituted as a potential deviant and as a morally suspect being requiring justification and science is redefined as a potentially dangerous enterprise. As a result, REBs are able to justify the need to control the researcher and regulate science, in other words, to interfere with the scientific process. The article concludes by advocating that instead of thinking ethics is an output that can be controlled, measured and verified, we should think of it as a point of equilibrium to be reached between the different parties involved in the research process.

Der Beitrag untersucht die Grundlagen und aktuellen Handlungsformen der Ethikkommissionen des CNRS in Frankreich. Sie basieren auf Prinzipien einer prozeduralen Ethik, deren Anwendung als Model allerdings hoch problematisch ist. Einerseits werden Forscher und Forscherinnen dabei als potentiell Deviante behandelt, andererseits wird die Wissenschaft als eine potentielle gefährliche Aktivität redefiniert. Darüber legitimiert sich die Notwendigkeit einer Kontrolle der Wissenschaftler und Wissenschaftlerinnen sowie die Regulierung der Wissenschaft, und damit der Eingriff in den wissenschaftlichen Prozess. Der Artikel schließt mit der Überlegung, Ethik in der Forschung nicht als mess-, kontrollier- und regulierbares Prinzip zu behandeln, sondern eher als ein zu erreichendes Gleichgewichtsprinzip zwischen den unterschiedlichen, an einem Forschungsprozess beteiligten Akteuren.

El artículo analiza las premisas y las formas de actuación y funcionamiento actual de los comités de ética para la investigación (Comités d’Éthique en Recherche – CÉR) que se apoyan en una ética procedimental cuya adopción y aplicación como modelo resulta bastante problemática. Por un lado, el investigador se presenta como potencial infractor, moralmente sospechoso. Por otro lado, dado que la ciencia se presenta ahora como potencialmente peligrosa, los CÉR se apresuran a controlarla y se inmiscuyen en el procedimiento científico. El artículo propone que se piense la ética, no como un principio que se puede medir, verificar o dominar, sino como un punto de equilibrio a lograr entre las distintas partes implicadas.
