Face aux revendications féministes qui développent une nouvelle approche du droit, une restructuration prenant en compte le féminisme prend un sens tout particulier dans les réformes de divers secteurs et notamment la refonte du droit des investissements internationaux. Notre article tentera d’analyser les fondements émergents d’une perspective féministe sur le droit international des investissements visant à réformer l’encadrement du système juridique des investissements internationaux. À cet égard, notre contribution analysera la réforme du droit international des investissements par le prisme de l’approche féministe et expliquera ses enjeux et ses orientations dans toutes les strates d’un tournant réformateur via une culture juridique propagée par une hétérogénéité de l’appréhension de l’approche genre.

Faced with feminist demands which are developing a new approach to law, a restructuring taking into account feminism takes on particular meaning in the reforms of various sectors and in particular the overhaul of international investment law. Our article will attempt to analyze the emerging foundations of a feminist perspective on international investment law aimed at reforming the framework of the legal system of international investments. In this regard, our contribution will analyze the reform of international investment law through the prism of the feminist approach and will explain its issues and its orientations in all the strata of a reforming turn via a legal culture propagated by a heterogeneity of apprehension of the gender approach.
