This chapter focuses on the meaning of Byzantine terms for strangers and foreigners (xenos, ethne, ethnikoi, allotrios) and recalls the meaning of asylum in the Theodosian Code. The example analysed is the refugee coming from foreign country who asks for Byzantium’s protection. Such a refugee, who is considered as a traitor in his/her own country, involved diplomatic relations between the States. The first section is devoted to political refugees in Byzantium, their conditions upon arriving in Byzantium, and consequently the right to asylum. The second part is devoted to the oath as the only legal standard of the refugee’s status. The paper concludes with the instability of this status and the blurry limit between prisoner of war and hostage.
