Le 18 novembre 2008, la CIJ se déclare compétente pour connaître du litige opposant la Croatie à la Serbie, à qui il est reproché d’avoir violé la convention sur le génocide de 1948 lors de la guerre des Balkans. La Cour rejette toutes les exceptions préliminaires soulevées par la Serbie. Elle confirme d’abord sa compétence ratione personae : bien que la Serbie ne soit devenue partie au statut de la Cour qu’après l’introduction de la requête, elle a qualité pour agir au jour du prononcé de l’arrêt. La Cour se reconnaît ensuite compétente ratione materiae : la Serbie est partie à la convention sur le génocide depuis le 27 avril 1992, en tant qu’État continuateur de l’ex-Yougoslavie. Concernant les exceptions ratione temporis et les exceptions portant sur le jugement des individus présumés coupables de crimes de droit international, sur l’identification des personnes disparues et sur la restitution des biens culturels, la Cour renvoie au fond leur examen.
