About one hundred year ago a fifteenth-century formulary was transferred from the State Archives in Mons to the University Library in Ghent, where it is now part of the rich medieval manuscript collection. Because of this transfer the manuscript was saved from the disastrous fire that would strike the archival depot of the Hainaut capital during the Second World War. Up until now, this source has not revealed much of its secrets so far and an in-depth study of it has not yet been conducted. However, the formulary offers a unique view on the late medieval organization of voluntary jurisdiction within the county of Hainaut and provides some important indications about the specific share in this of comital vassals or hommes de fief. Because of the value of this manuscript a critical text edition is required to render its content more accessible. This contribution aims to meet this need in the first place, but also tends to (1) elaborate on the facts that are already known ; (2) formulate alternatives to nuance former interpretations ; (3) initiate additional research to fill in the existing gaps.

Il y a presque cent ans, un formulaire du XVe siècle a été transféré des Archives de l’État à Mons à la Bibliothèque de l’Université de Gand, où, depuis lors, il fait partie de la riche collection des manuscrits médiévaux. Ce transfert a sauvé le manuscrit de l’incendie catastrophique qui a frappé le dépôt d’archives dans la capitale du Hainaut pendant la Seconde Guerre mondiale. Jusqu’à présent, cette source a gardé ses secrets car une étude approfondie de celle-ci fait encore défaut. Cependant, le formulaire offre un aperçu unique de l’organisation de la juridiction gracieuse à la fin du Moyen Âge dans le comté de Hainaut et fournit des indications importantes sur le rôle spécifique des hommes de fief. Compte tenu de la valeur de ce manuscrit, une édition critique du texte s’impose donc afin de rendre son contenu plus accessible. Cette contribution veut en premier lieu répondre à ce besoin, mais elle vise également à (1) approfondir les faits déjà connus ; (2) formuler des alternatives afin de nuancer les interprétations antérieures ; (3) lancer des recherches supplémentaires pour combler les lacunes existantes.

Ongeveer honderd jaar geleden werd vanuit het Rijksarchief van Bergen een vijftiende-eeuws formulierboek overgebracht naar de Gentse Universiteitsbibliotheek, waar het sindsdien deel uitmaakt van de rijke middeleeuwse handschriftencollectie. Door deze ruiltransactie bleef het manuscript gespaard van de desastreuze brand die het archiefdepot in de Henegouwse hoofdstad zou treffen tijdens de Tweede Wereldoorlog. Tot nog toe heeft deze bron niet veel van haar geheimen prijsgegeven en bleef een diepgaande studie ervan uit. Het formulierboek biedt evenwel een unieke inkijk in de laatmiddeleeuwse organisatie van de vrijwillige rechtspraak binnen het graafschap Henegouwen en levert enkele belangrijke indicaties op over de specifieke rol daarin van onder meer grafelijke leenmannen of hommes de fief. Gezien de waarde van dit handschrift dringt zich een kritische teksteditie op om de inhoud ervan toegankelijker te maken. Aan die nood wil deze bijdrage in de eerste plaats tegemoetkomen, maar inleidend beoogt ze evenzeer om (1) dieper in te gaan op de feiten die reeds gekend zijn ; (2) alternatieven te formuleren om eertijdse interpretaties te nuanceren ; (3) een aanzet te geven tot bijkomend onderzoek om hiaten op te vullen.
