This paper examines the lex curiata in the light of the auspices the magistrates took at their entry into office and gives it a new interpretation. The comitia curiata have survived auspiciorum causa not because of a right of auspices that the curiate law would have granted to the magistrates but because of the auspices that any magistrate took at the dawn of its entry in charge. This law gave the magistrates a perfect legitimacy after their election and also after the gods had confirmed this choice by the “ investing auspices”. If one accepts this interpretation, the texts on the curiate law no longer appear to be contradictory and receive new insights.

Examinée à la lumière des auspices d’entrée en charge des magistrats, la loi curiate fait ici l’objet d’une interprétation profondément renouvelée. Les comices curiates ont subsisté auspiciorum causa, non pas en raison d’un droit d’auspices qu’aurait attribué la loi curiate mais à cause des auspices que prenait tout magistrat à l’aube de son entrée en charge. Cette loi conférait aux magistrats une légitimité totale, après leur élection mais aussi après que les dieux avaient, lors des auspices d’entrée en charge, confirmé le choix posé par le peuple. Si l’on accepte cette interprétation, il apparaît que les textes relatifs à la loi curiate, qui jusqu’alors semblaient en partie contradictoires, peuvent recevoir un nouvel éclairage et faire l’objet d’une lecture cohérente.
