Comment les honoraires de l'avocat sont-ils établis pour les dossiers de justice pénale, où les clients ont la double particularité d'être peu argentés et/ou peu honnêtes ? Selon l'auteur, la notion déontologique de désintéressement permet de structurer la relation entre les deux protagonistes. Elle fournit les clés à la négociation de l'honoraire, dont on retrouve les termes dans l'élaboration du système de défense en commun comme dans la définition du fondement éthique de la relation professionnelle. L'avocat peut ainsi conserver une position dominante dans la relation, tout en laissant au client une marge d'autonomie, y compris dans la modulation de l'honoraire. Il a en outre la possibilité de garder toute l'autorité dans la détermination de sa valeur économique sur le marché des affaires pénales et partant, de ne pas se soumettre à la loi de l'offre et de la demande.
