Using the case of an important capital goods industry the paper examines the impact of the national patent system on the performance of firms. Many theories attempt to explain the firms’ innovative behavior using the concepts of national and sectorial systems of innovation. Patents play a particularly important role in these systems. At the level of the firm their importance rests on the possibility to appropriate profits. The empirical analysis of a sample of 49 manufacturers of machine tools show that patents are a superior mechanism for appropriating the returns on R&D in this industry. This is indicated by a strong positive relationship between the market value of the firm and its patenting activities.

Cet article examine l'impact des différents systèmes nationaux de brevet sur les performances des firmes d’une industrie de biens-capitaux. Un grand nombre de théories tentent d’expliquer le comportement d’innovation des firmes à l’aide des concepts de systèmes nationaux ou sectoriels d’innovation. Le brevet joue un rôle essentiel dans ces systèmes. Pour les firmes, son importance repose sur les possibili- tés d’appropriation des profits issus de l’innovation. Une analyse empirique sur quarante-neuf entreprises du secteur de la machine-outil montre que le brevet constitue un procédé efficace pour une telle appropriation. Il y a une relation positive et forte entre l’activité de dépôt de brevet et la valeur des actifs des firmes.
