First, the paper looks at the elaboration step by step of the Law of the Sea through the historical period and at the major points of the New Law of the Sea concerning the maritime transport. On one hand new rules improve security at sea, on the other hand, liberalism increases all along the international transport chain. In fact, competition between the players induce more terrestrial battles than maritime ones. The North Atlantic is an example of both cooperation and competition between shipowners.

L'article montre d'abord la mise en place progressive dans l'histoire du Droit de la mer et les principaux aspects du nouveau Droit de la Mer intéressant le transport maritime. Aux nouvelles réglementations qui améliorent la sécurité en mer répond une augmentation de la liberté d'entreprendre le long de la filière de transport. En fait la compétition entre les acteurs se traduit par des batailles plus terrestres que maritimes. L'Atlantique Nord est un exemple de coopération entre les armements dans un contexte de très forte concurrence.
