Since the 1978 Constitution, Spain has experienced a new form of Church-state relations which is radically different from the past. This article attempts to highlight the philosophy behind this change by analyzing the motivations of the principal protagonists involved in formulating the fundamental law. It thus attempts to show that mention of the Catholic church in the Constitution is not a mark of disguised confessional commitment. Rather, this formula had as its objective a taking into account of the country's historical and sociological past, the pacific move to an aconfessional state and the definitive resolution of Spain 's religious question.

L'Espagne connaît, depuis l'instauration de la Constitution de 1978, de nouvelles formes de relations Église-État, en rupture avec une grande partie de son passé. Cet article cherche à en dégager la philosophie, en se basant sur l'analyse des motivations des principaux protagonistes de la période d'élaboration du texte fondamental. Il tente ainsi de montrer que la mention de l'Église catholique dans la Constitution ne se veut pas la marque d'une confessionnalité déguisée, mais a surtout pour but, par la prise en compte de la réalité historique et sociologique du pays, le passage à un État aconfessionnel par un processus pacifique et la résolution définitive de la question religieuse en Espagne.
