Die kirchenrechtlichen Grundlagen für die Verwaltung eines Bistums und den Schutz seiner Güter während einer Sedisvakanz waren im 11. Jahrhundert vor allem in papstfernen Regionen im vorgratianischen Kirchenrecht noch nicht sehr ausgeprägt und sollten sich im Verlauf des 12. Jahrhunderts erst mit der normierenden Zusammenstellung des Decretum Gratiani und seinen postgratianischen Interpretationen ändern. Nach einem allgemeinen Überblick über die entsprechenden kanonistischen Entwicklungen bis zum Ende des Hochmittelalters werden die realen Hintergründe mit ihren kirchenpolitischen und realpolitischen Implikationen sowie die Auswüchse einer Sedisvakanz anhand der Verhältnisse und Streitigkeiten am Metropolitansitz von Narbonne aufgezeigt, wo mit der Klageschrift der Querimonia Berengarii eine zeitgenössische Quelle erster Güte entstanden ist.
In the 11th century the legal bases for the administration of a diocese and the protection of its property during a vacancy were not yet well defined in pre-Gratian canon law, especially in regions far distant from Rome and the Papacy, until the emergence of the normative compilation of the Decretum Gratiani and its post-Gratian interpretations in the course of the 12th century. After a general overview of the development of canon law until the end of the High Middle Ages, the factual background of vacancies with their canonical and political implications and excesses is shown, using as an example the state of affairs and conflicts in the Metropolitan See of Narbonne, where the complaint of the viscount against the archbishop, the Querimonia Berengarii, provides us with a first-quality contemporary source.
Au XIe siècle, les bases juridiques de l’administration d’un diocèse et la protection de ses biens pendant une vacance du siège n’étaient pas encore suffisamment inscrites dans le droit canonique d’avant Gratien, surtout dans les régions très éloignées de Rome et de la papauté. Cette situation changera seulement au cours du xiie siècle grâce à la compilation normative du Decretum Gratiani, et plus tard grâce à ses interprétations. Après avoir donné un aperçu général du développement du droit canonique en cette matière jusqu’à la fin du Moyen Âge classique, le contexte réel d’une vacance du siège, avec ses implications ecclésiastiques et politiques et ses pires pratiques et abus, est présenté au travers de l’exemple du siège métropolitain de Narbonne, où la requête du vicomte, la Querimonia Berengarii, nous fournit une source contemporaine de première qualité pour démontrer les rapports internes et les conflits au sein d’un tel diocèse.
In de elfde eeuw was de rechtsgrondslag voor de administratie van een bisdom en de bescherming van zijn eigendommen tijdens een vacature nog niet voldoende verankerd in het kerkelijk recht voor de tijd van Gratianus, vooral in gebieden zeer afgelegen van Rome en het pausdom. Dit verandert slechts tijdens de twaalfde eeuw dankzij het Decretum Gratiani, een compilatie van normen, en van zijn latere interpretaties. Het artikel biedt eerst een algemeen overzicht van de ontwikkeling van het kerkelijk recht in deze materie tot het einde van de klassieke Middeleeuwen. Dan wordt de context van een historische vacature uiteengezet inclusief zijn kerkelijke en politieke implicaties, zijn ontelbare misbruiken en slechte praktijken ; het concrete voorbeeld van de Querimonia Berengarii, het verzoek van de Burggraaf betreffende de aartsbisschoppelijke zetel van Narbonne, geeft ons een eigentijdse, hoge kwaliteitsbron van de interne relaties en conflicten binnen zo‘ n bisdom.
