This study examines within an organic framework the problem of the ager compascuus through a new scrutiny of the sources that attests to its existence and its characteristics. The following themes are among others dealt with : the distinct categories of local pasture-land ; the juridical nature of the ius compascendi ; the public entities granting it ; the ius compascendi constituted through contracts between private landowners ; the relationship between the ager compascuus and the ager scripturarius ; an analysis of the modem theories concerning the pre-Roman ager compascuus and the nature of the primitive ager compascuus ; the economic function of the ager compascuus. Finally the a. inquires about whether certain forms of collective exploitation of pasture-land, attested during the medieval period and also in modern times (e.g. the so-called "usi civici"), can be seen as a continuation of the institution of ager compascuus.

Cette étude traite dans un contexte organique du problème de l'ager compascuus à travers un nouvel examen des sources qui nous en témoignent l'existence et les caractéristiques. Elle aborde entre autres les thèmes suivants : les différentes catégories de pâturages au niveau local ; la nature juridique du ius compascendi ; les entités publiques qui concédaient ce droit ; le ius compascendi constitué par voie contractuelle entre des propriétaires de fundi privés ; le rapport entre l'ager compascuus et l'ager scripturarius ; l'analyse des théories modernes au sujet de l'ager compascuus pré-romain et le régime de l'ager compascuus originel ; la fonction économique de l'ager compascuus. L'a. aborde enfin le problème de l'éventuelle continuité de l'institution de l'ager compascuus dans certaines formes d'exploitation collective de pâturages qui nous sont témoignées au Moyen Âge et aussi à l'âge moderne (les soi-disant "usi civici").
