Numerous European countries enable couples of both the saine and different sexes to enter a registered partnership. In the South, a partnership is available to couples of both the same and different sexes and sets up a new form of personal union. In the North, a partnership is available to persons of the same sex and has practically the same consequences as marriage. The law applicable to partnership depends on its specifie nature. In one case, French law concerning registered partnership clashes with an equivalent foreign law. In the other, French law concerning marriage clashes with foreign law concerning same-sex marriage.

Au travers du partenariat enregistré, de nombreux pays d'Europe offrent aujourd'hui aux couples hétérosexuels ou homosexuels un nouveau cadre juridique. Alors qu'au Sud, le partenariat est ouvert à tous les couples et institue une nouvelle forme d'union personnelle, au Nord, il est réservé aux couples homosexuels et s'apparente nettement au mariage. La loi applicable au partenariat dépend de sa nature spécifique. Dans un cas, la loi française sur le pacte civil de solidarité entre en conflit avec une loi étrangère équivalente. Dans l'autre, la loi française sur le mariage entre en conflit avec une loi étrangère consacrant un mariage homosexuel.
