Marking the beginning of Chinese economic reform, the reform of the system of state-owned land has led to the emergence and the prosperity of land market in China. Different from the practice in the countries where the private ownership prevails, the subject matter of this particular land market is the right to use state-owned land for construction. Such right is explicitly defined as usufructs by the Property Law adopted in 2007, which has made a tremendous progress in the reform process. However, the land reform must continue. This article will mainly focus on the relationship between the right to use state-owned land and its ownership, and the necessity of further reform.

Première étape de la réforme économique de la Chine, la réforme du droit d’usage du terrain d’État crée un marché foncier tout en maintenant le système de la propriété publique. La loi sur les droits réels de 2007 confirme la nature de droit réel du droit d’usage du terrain d’État. C’est là un progrès important dans la mesure où le droit chinois évolue vers davantage de protection de la propriété privée. Or, la réforme n’est pas terminée. L’objectif de notre article est d’analyser l’écart entre le droit d’usage du terrain d’État et la propriété et d’expliquer la nécessité de poursuivre ce mouvement dans l’avenir.
