Urbanization grows on land and is designed, in most projects, around the available spaces. The construction of housing estates, major land consumers, has generated real estate transfers and changes in land use. This resulted in conflicts between the notions of public utility and private interest and issues such as the content and limits of the right of ownership. This approach revealed the need to find a balance between individual rights, deemed intangible, and the social constraints which might reduce them.

L'urbanisation se nourrit de terrain et se conçoit, dans la grande majorité des projets, à partir d'espaces disponibles. La réalisation des grands ensembles, importants consommateurs de terrains, a généré des transferts fonciers et des modifications d'utilisation des sols sur lesquels se sont confrontées les notions d'utilité publique et d'intérêt particulier, comme ont été soulevées des interrogations sur le contenu et les limites du droit de propriété. La démarche a mis en avant la nécessité de recherche d'un équilibre entre les droits individuels réputés intangibles et les contraintes sociales qui peuvent les amoindrir.
