Las ciudades argentinas y latinoamericanas presentan una importante conflictividad social por el acceso y la tenencia del suelo urbano. Una manifestación de esa problemática son las tomas de tierra y los procesos de autoproducción de barrios por parte no solo de sectores populares, sino también de capas medias de la población. Otro aspecto de este conflicto es la existencia de tierras que, loteadas en un pasado lejano, están en situación de abandono por propietarios ausentes. Y cabe entonces preguntarse: ¿pueden coexistir propiedades abandonadas con demandas insatisfechas de suelo urbano? Y en todo caso, ¿cómo puede intervenir el Estado ante un andamiaje legal que protege la propiedad sin propietario? Los autores de este libro buscan develar el origen de esta situación paradójica y contribuir a la intervención del Estado a favor de la ampliación del acceso al suelo urbano. Asimismo, para no quedarse en el plano meramente analítico, proponen el estudio del caso de la ciudad de San Carlos de Bariloche y una forma de resolución a partir de una herramienta legislativa concreta.

Argentinean and Latin American cities present important social conflicts over access to and ownership of urban land. One manifestation of this problem is the seizure of land and the processes of self-production of neighbourhoods not only by popular sectors, but also by the middle strata of the population. Another aspect of this conflict is the existence of land that was allocated in the distant past and is now abandoned by absentee owners. The question then arises: can abandoned properties coexist with unsatisfied demands for urban land? And in any case, how can the state intervene in the face of a legal framework that protects ownerless property? The authors of this book seek to unveil the origin of this paradoxical situation and to contribute to state intervention in favour of expanding access to urban land. Furthermore, in order to go beyond the merely analytical level, they propose a case study of the city of San Carlos de Bariloche and a way of resolving it through a concrete legislative tool.
