A intervenção com crianças vítimas de violência doméstica interparental em Aragão (Espanha): resposta judicial e assistência social integrada

A intervenção em casos de crianças expostas à violência doméstica interparental sofreu transformações nos últimos anos. Atualmente, estas crianças são vistas como vítimas, que necessitam de uma intervenção social integrada, não só quando são vítimas diretas, mas também quando testemunham ou são expostas à violência de género. Esta mudança também se reflete no sistema de justiça penal. Neste artigo discutem-se os principais elementos do enquadramento teórico e jurídico que refletem estas transformações em Espanha. Simultaneamente, são analisadas as principais características do modelo de intervenção desenvolvido na Comunidad Autónoma de Aragón (Espanha). Por fim, são discutidas as conclusões da pesquisa realizada pelo Laboratório de Sociologia do Direito da Universidade de Saragoça em parceria com o Instituto Aragonés de la Mujer (IAM), em 2013, sobre as respostas a este problema na região de Aragão (Espanha).

The intervention with children exposed to domestic inter-parental violence has changed in the last years. Nowadays, these children are perceived as victims needing a comprehensive social intervention, not only when they are direct victims of this violence, but also when they witness or are exposed to it. This change also reflects on Criminal Justice. In this paper, the main elements of the legal and theoretical framework reflecting those changes are analyzed in the Spanish context. At the same time, the main characteristics of the intervention model designed in the Comunidad Autónoma of Aragon (Spain) are exposed. Finally, a discussion follows based on the conclusions of the research by the Laboratory of the Sociology of Law (Universidad of Zaragoza), in collaboration with the Instituto Aragonés de la Mujer (IAM) about the response to this problem in Aragon (Spain).
