Gli Statuti del comune di Arezzo nei secoli XIV e XV

Dopo una breve rassegna delle prime attestazioni indirette di statuti del comune di Arezzo (dalla fine del sec. XII agli inizi del sec. XIV), nel contributo vengono analizzati i processi compositivi e le caratteristiche materiali degli statuti aretini trecenteschi conservati (risalenti agli anni 1327, 1337, 1342, 1345) che hanno tutti la stessa struttura in quattro libri e che sono stati composti ‘per sedimentazione’, cioè aggiornando e integrando la normativa più antica. Viene quindi presa in esame la normativa vigente ad Arezzo dopo che la città fu sottomessa da Firenze, nel 1384. Il nuovo assetto istituzionale comportò l’elaborazione di norme da parte di ufficiali fiorentini (le « riforme », che per alcune caratteristiche sono avvicinabili agli statuti), ma preservò anche uno spazio per statuti composti dalla città soggetta; gli statuti aretini quattrocenteschi, però, si differenziano dai loro predecessori trecenteschi per l’articolazione, per le dimensioni, e per la necessità di ricevere l’approvazione da parte della Dominante.

After a brief review of the first mentions of statutes of the commune of Arezzo (from the end of XIIth century to the beginning of XIVh century), the article analyzes the processes of composition and material characteristics of the yet preserved statutes of Arezzo of XIVh century (dated 1327, 1337, 1342, 1345), which all have the same structure in four books and have been composed updating and integrating the old legislation. Is also taken into consideration the legislation in force in Arezzo after the city was conquered by Florence in 1384. The new government decided the writing of laws by the Florentine officers (the « reformations », that are for some features similar to the statutes) but also preserved a space for statutes written in the subdued city; the statutes of Arezzo of XVh century, however, differ from their predecessors for the structure, the size, and the obligation to be approved by Florence.
