Il contributo sintetizza gli ultimi anni di ricerca sulle peculiarità dello statuto di Siena del 1310, il primo conservato in volgare italiano per una città, nel contesto della storia cittadina. Ѐ un testo che presenta degli aspetti singolari sia dal punto di vista politico che giuridico. Sul piano politico c’è una forte presenza di norme ideologiche di tipo ‘popolare’, antimagnatizio, con l’idea della leggibilità della legge anche per le ‘povere’ persone che non sanno il latino; sul piano giuridico la polemica è feroce contro il sistema tradizionale di giustizia. Interessante che ci sia anche largo spazio alla giustizia alternativa mediante compromessi obbligatori tra le parti. Il Costituto segna quindi un momento di particolare tensione all’interno del sistema giuridico, ormai dominato dalle interpretazioni dei dottori, con consuete lungaggini processuali. Molto significativo, però, è che la giustizia alternativa auspicata non abbia avuto successo. Siena in pochi anni si assicura buoni professori di diritto e un nuovo statuto (negli anni del Buongoverno del Lorenzetti, 1338) che non ha più queste norme polemiche esplicite contro i giuristi.
