Eiximenis, un grande comunicatore : non solo sulla moneta

Il testo edito da Paolo Evangelisti è di grande interesse per chi si occupi di storia del diritto e delle istituzioni per l’oggetto e per il modo di comunicare proposte per risolvere i grandi problemi di quel tempo. Infatti è testo di un teologo con buone conoscenze giuridiche che affronta un tema di estrema delicatezza, coinvolgendo il sommo problema del potere sovrano, ma senza utilizzare esplicitamente i giuristi del tempo, né quelli precedenti. Il diritto sia canonico che civile rimane sottinteso per sostenere questa o quella tesi. L’opzione deriva non già da disinteresse, com’è intuibile, ma dalla scelta fondamentale di costruire un testo con destinatari precisi : principi e amministratori di comunità senza affrontare la tradizione universitaria in materia. C’è un’analisi della realtà socio-economica del tutto pragmatica, senza influenze di preconcetti dottrinali per auspicare una politica, non solo della moneta, per il bene comune della Res publica.

The text edited by Paolo Evangelisti is of great interest for an historian interested in law and institutions. Eximenis’ topics and his way of sharing his solutions give large reasons of interest. The author is a theologian with a good legal culture who considers problems of great importance being connected with the question of the sovereign power; anyway, he does not openly utilize the jurists of his time neither their ancestors. He does quote only the official sources of civil and canon law for his aims but he evoids to discuss his ideas with the jurists. That means his choice for building a text to be dicated precisely to princes and administrators of communities, without any obstacle of the university culture. Indeed, E. draws an analysis of the economic context without doctrinal prejudices and wishes political and economic choices in favour of the common wealth of the Res publica.
