Appréhender l’imprécision des droits : approche linguistique

Cette contribution envisage une approche linguistique de l'imprécision des droits. Elle implique en premier lieu l'identification des contraintes supposées par une telle approche, en vue de définir un objet – les jugements d’imprécision – et une méthode – l’approche linguistique pragmatique – à même d’appréhender la communication juridique. Par suite, l’analyse conduira à distinguer l'imprécision du droit de l'imprécision du langage ordinaire, avant, au cœur même de l’imprécision du droit, de permettre la caractérisation linguistique de l'imprécision des droits de l’Homme.

This contribution is considering a linguistic approach to the imprecision of rights. It necessarily begins with the recognition of the constraints supposed by such an approach, in order to define an object – the judgements of imprecision – and a method – the pragmatic linguistic approach – suitable to the legal communication. Thereby, the analysis will lead to a distinction between the legal imprecision and the ordinary language imprecision. We will then identify, within the field of the legal imprecision, the linguistic lineaments of the human rights imprecision.
