Léon Duguit a placé toute son œuvre sous le signe de la protection des libertés de l’individu contre l’État. En optant cependant pour une logique solidariste plutôt que pour la logique individualiste familière aux auteurs libéraux, il aboutit malgré lui à des conclusions systématiquement hostiles à la liberté de l’individu : l’État chez lui n’est pas limité mais illimité, l’individu n’est pas libéré mais contrôlé, la propriété privée n’est pas garantie mais surveillée. Plus qu’à garantir les libertés, le système de Duguit semble viser en fait à assurer la prééminence au sein de la société d’une caste, la sienne : les juristes, et s’inscrire au fond dans la continuité d’un auteur qu’il cite rarement mais dont il est manifestement proche : Comte.

Léon Duguit dedicated all his work to the protection of individual freedoms against the State. By opting, however, for a solidarist logic rather than the individualist logic familiar to liberal authors, he arrived in spite of himself at conclusions that were systematically hostile to the freedom of the individual: the State for him was not limited but unlimited, the individual was not freed but controlled, private property was not guaranteed but monitored. Rather than guaranteeing freedoms, Duguit’s system seems in fact to aim to ensure the pre-eminence within society of a caste, his own: the jurists, and to be basically in line with an author whom he rarely quotes but is obviously close to: Comte.
