Because of its unusual character, the Trump presidency has challenged the American constitutional order and raised many unprecedented questions. Donald Trump’s relationship to the Constitution raises three questions: how he forces us to re-envisage the fundamental law, inducing a densification of the constitutional discourse; how he violates it, raising the delicate issue of sanctions; and, finally, how he shapes it. The article pays special attention to the way judges affect that dynamic because, while they are the first to face Donald Trump’s peculiar actions, they also represent the main means through which he shapes the Constitution by nominating Supreme Court justices.
