Avoiding ideological positioning, this papertries to determine, from a legal analyst's point of view, whether the Constitutional Council is overzealous with regards to the competences granted to it by the Constitution. An analysis of the cases which constitute an 'excessive use of constitutional power' and of those which constitute a 'denial of constitutional justice' tends to illustrate the liberties the Constitutional Council sometimes takes with the constitutional rule.
