The offense of driving under the influence of alcohol is emblematic of all the changes that have affected criminal justice during the 2000s. Courts are overwhelmed by drunk driving cases, which can now pass through a number of judicial channels. The treatment of offenses depends on courts’ configurations and local criteria, as well as perpetrators’ profiles and the characteristics of the infraction. Since the creation of new judicial proceedings, prosecutors and judges have developed new ways of thinking and acting. Therefore, oppositions are emerging, linked to the magistrates’ convictions and the meanings they give to their mission.
