La structure de la règle de droit, selon H. Motulsky a un caractère à la fois logique et structural. Peut-on pour autant réduire la pensée de celui-ci à un positivisme logique ou à un structuralisme ? Il est permis d’en douter : la structure de la règle de droit qui, selon H. Motulsky, consiste en l’association d’une présupposition et d’un effet juridique, ainsi que la conception structurale du droit subjectif qu’il défend dans sa thèse, ne relèvent ni d’un pur positivisme logique, ni d’un structuralisme au sens méthodologique et épistémologique du terme. Il n’y a pas d’analyse structurale de la règle de droit dans les travaux méthodologiques d’H. Motulsky au sens technique du terme, et pourtant, sa pensée de la structure de la règle de droit relève par certains aspects d’un structuralisme « global ». Cette clé de lecture permet de revisiter les limites que certains auteurs ont assigné à ses travaux méthodologiques à travers une réflexion sur la notion de « présupposition ».

The structure of the rule of law, according to H. Motulsky, has both a logical and a structural character. Can we therefore reduce his thought to a logical positivism or a structuralism? This is questionable : the structure of the rule of law which, according to H. Motulsky, consists of the association of a presupposition and a legal effect, as well as the structural conception of the subjective right which he defends in his thesis, are neither a pure logical positivism nor a structuralism in the methodological and epistemological sense of the term. There is no structural analysis of the rule of law in the methodological works of H. Motulsky in the technical sense of the term, and yet his thinking on the structure of the rule of law has certain aspects of “global” structuralism. This reading key makes it possible to revisit the limits that certain authors have assigned to his methodological work through a reflection on the notion of “presupposition”.
